Belastingaangifte 2019 - privé of zakelijk bankrekening

Hallo,

 

Help me alstublieft te begrijpen. Ik ging veel plaatsen online, maar ik kon geen antwoord vinden. Ik wil weten hoe ik aangifte moet doen voor mijn jaarlijkse aangifte inkomstenbelasting.

 

Ik ben een eenmanszaak. Ik heb KVK en BTW geregistreerd. Ik heb maar één bankrekening. Ik gebruik de bankrekening zowel zakelijk als privé.

 

Bijvoorbeeld, op 1 januari is mijn bankrekeningsaldo 9000. Mijn bedrijfsactiva is 6000 (inclusief bankrente van 6 euro) en mijn particuliere spaarbedrag is 3000 (inclusief bankrente van 3 euro).

 

In welk geval is het correct om het formulier in te vullen? Optie 1 of Optie 2?

Eigen vermogen 6000 euro

Inkomsten uit banktegoeden 6 euro

Saldo op 1 januari 2019 3.000 euro

 

[Optie 2]

Eigen vermogen 0 euro

Inkomsten uit banktegoeden 0 euro

Please help me to understand. I went many places online but I could not find any answer. I want to know how to declare for my annual income tax filing.

 

I am a freelancer. I have KVK and BTW registered. I only have one bank account. I use the bank account for both business and private.

 

For example, on 1 st of January,  my bank account balance is 9000. My business asset is 6000  (including bank interest of 6 euros) and my private saving amount is 3000 (including bank interest of 3 euros).  

 

In this case, in which is correct to fill in the form? Option 1 or Option 2?

Eigen vermogen 6000 euro

Opbrengsten banktegoeden 6 euro

Saldo op 1 januari 2019  3000 euro

 

[Option 2]

Use option 2.

 

You have a private bank account, the balance on jan 1st is a privat asset (prive bezit) this is used to determine if you exeed the BOX 3 limit for non-taxable savings

Income from the bankaccount is also private income and not taxable because in NL you pay income tax on a ficticious income from savings and not the actual interest.

 

All the cost you paid can be booked as privéstorting in your books and tax statement

All revenue you received on the private bankacc. can be booked as privéontrekking (of privéopname)

These accounts are also grouped under Eigen vermogen

Ik geef je trouwens extra informatie over mijn bank:

 

9000 = totaal geld op mijn bankrekening
3000 = alleen mijn inkomen uit zaken.
6000 = alleen mijn spaargeld van mijn vorige baan. Ik hou alleen. Ik trek me niet terug. Ik zal alleen gebruiken als mijn bedrijf een onverwachte aankoop nodig heeft.

 

*Voor privé boodschappen bijvoorbeeld supermarkt gebruik ik geld van mijn man. Ik gebruik mijn bankrekening niet om privé te winkelen.

Is het dan niet makkelijker om die hele bankrekening als zakelijk aan te merken?

Dan boek je eenmalig een storting in de eenmanszaak van 3000 en beschouw je alles als zakelijk vermogen.

 

 

(In je openingspost heb je het overigens over 3000 spaargeld en in je laatste post over 6000)

 

Over 3000 of 6000 privégeld (cash overschot) in je eenmanszaak zal de belastingdienst niet vallen. Wanneer dit bedrag veel hoger gaat worden en je hebt het duidelijk niet nodig voor het voeren van de zaak, dan kunnen ze het wel als box 3 vermogen beschouwen.

Sorry dat mijn geldbedrag per ongeluk is verwisseld. Mijn totale geld op mijn bankrekening is 9000. Het bedrijfssaldo is 6000. Het spaargeld van mijn vorige baan is 3000.

Ok, laten we even bij het begin beginnen.

Ben je afgelopen jaar begonnen met de eenmanszaak? (want ik zie een begin Eigen vermogen van 0)

 

Als dat zo is dan dien je nu eerst even een fatsoenlijke Winst en Verliesrekening (W&V) en Balans op te stellen voordat je de aangifte in gaat vullen. Op zich lijkt dat moeilijk maar is het eigenlijk niet. Pak bijgaande xlsx bestand en begin met het invullen van de gele invulvelden.

 

Als alles ingegeven is dan kun je bij de aangifte alles overnemen. Waarschijnlijk zul je in de aangifte (buiten het ondernemersgedeelte) een privéstorting van 3000 aangeven (want dat is het bedrag dat je als spaargeld beschouwt, maar op de 'zakelijke rekening' staat).

 

De uiteindelijke stelregel is ook

EV eind jaar = EV begin jaar + Resultaat uit W&V + Privé stortingen - Privé opnames

 

Als verder de activa en passiva goed ingegeven zijn zal het verschil nul moeten zijn.

 

(zo zie je dat met de door jou verstrekte gegevens niet zomaar het EV bepaald kan worden)

Bedankt voor je advies. Erg behulpzaam. Ik ben in 2018 begonnen, maar ik heb dit voorbeeld gemaakt om eenvoudige cijfers te zien. Het spijt me dat ik mijn voorbeeld verander. Hoe zit het met dit onderstaande voorbeeld?

 

Verklaar ik als OPTIE 4? of OPTIE 2? of beide zijn correct?

"enige privé-bankrekening"?

Wordt die bankrekening alleen puur voor zakelijke doeleinden gebruikt? (op het 'spaar' saldo na?)

Dan zou ik gewoon de volledige bankrekening als zakelijk aanmerken.

Dus 3000 privé storting opgeven en 9000 opgeven in de balans als saldo.

En bij de bankrekeningen aanvinken dat deze bankrekening zakelijk is (dan wordt ie niet in box 3 meegenomen).

Dit spreekt dat dan weer tegen.

Dan zou je dus je saldo in de balans op 0 kunnen zetten en 6000 als privé opname opgeven.

Maybe it is easier if we clarify that with mixed use of assets, you may actually choose yourself if you want it to be a private or business asset.

 

When you use something less that 10% for business purposes, you must always regard it as a private asset

When you use something more than 90% for business purposes, you must always regard it as a business asset.

When you use something between 10% and 90% for business purposes, you get to choose how the tax office should regard that asset.

 

So, if you have a bank account that you use for both private and business purposes, you get to decide yourself how you want to label it. However, you must make this choice at the start of your business or the moment you start using the asset. If you say you started your business in 2018, you probably already filed your taxes for that year. How was the bank account labeled in that year? As a private or business asset?

Thank you for the clarification. I have not declared my bank account in 'income tax filing 2018' since I had 30% ruling and I was told I do not need to declare yet.

Please allow me to stick with this example:

On January 1, 2019 in my one bank account:

Maybe we should do some 'first things first'.

 

1. You say you have a business that was registered at the Chambre of Commerce and at the tax office for sales tax purposes (omzetbelasting / btw). When did you register your  company at the Chamber of Commerce? In what year? 2018 or 2019?

 

2. You are trying to declare your 2019 income from your business in your income tax filing. However - confusingly enough - you only have to file as a business, if you meet all the criteria to do so. If your business is not 'big' or 'substantive' enough, you obviously still own a business, but you don't have to file as a business (which means you don't have to fill out the balance sheet). Find out if you are a business for income tax purposes here.

 

3. You said you did not declare your bank account in 2018, because your employer used the 30% ruling. I feel like these things are completely unrelated. Your employer can give you up 30% of your wage tax free, but this does not mean that you can omit declaring any of your other sources of  income. Did you file your income for 2018 at all? Or did you just omit certain things on it? Did you get a question about your bank and savings accounts? How did you answer those in 2018?

1. I registered KVK and BTW in 2018. 


2. With doing business under my private bank account, I did not know I did not need to declare business balance sheet under Income Tax Filing 2018. I already input the balance (Beginning of year as 0, End of year as 2000)  in my Income Tax Filing 2018. So I plan to declare business balance sheet (Beginning of year as 2000, End of year as 0)  for Income Tax Filing 2019. 


3. I declared all Income of 2018. I did not declare all my bank and savings account amount of 2018 because of 30% ruling.

 

I am thinking to declare like Option 5 and from next year, I understand I do not need to input any business balance sheet from Income Tax Filing 2020.

You are making assumptions here. It is not certain that you need to declare your business balance sheet at all. That's why you need to do the OndernemersCheck first. What is the result of that Check, if you answer it for the year 2018 and 2019 seperately? You should go through the questions 2 times, once for each year - and save the result. When we know the answer to that question, we can go to the next step.

Again, how are these two things related? The 30% ruling has nothing to do with whether or not you should declare your savings account - or how you should declare those. But we can not answer your question how to declare your savings account, because it depends on the answer to the question above.

Ok, this makes it a little clearer, but past choices have future consequences. So (implicit) choices made for 2018 will now carry over to 2019.

 

You may be familiar with the different 'boxes' within the Dutch income tax system:

- box 1 taxes income from work and home (37-50%)
- box 2 taxes mainly dividends (26,5%)

- box 3 taxes savings and investments (30%)

 

With the 30% ruling you get the 30% tax free in box 1, but are treated as a normal resident otherwise in box 1. But at the same time you are treated as a NON-resident for income in box 2 and box 3, which means you do not declare those sources of income in the Netherlands.

 

Now with regard to your bank and/or savings account, it either falls in box 1 (if you want it to be a business asset), or it falls in box 3 (if you want it to be a private asset). From your answers, I gather that you did not declare the savings and bank account in box 1 (you didn't declare them as business assets), which automatically means you implicitly declared them in box 3 as private assets. Where they remain untaxed in you declare yourself a partial non-resident taxpayer, as far as I understand, because of the exemption for foreign assets.

 

However, it is a question if the bank and/or savings account qualify as foreign or non-Dutch sourced income assets though. I simply don't know that. But even if you don't declare partial non-residency for box 3 and the bank and savings account are declared in box 3 as private assets, you don't pay taxes if they don't exceed some 60-odd thousand euro for couples filing jointly. That's the regular exemption for residents anyway.

 

Because of this choice in 2018, you cannot change it in 2019. This means you must keep the bank and savings accounts as a private asset. As a result, you probably should not declare the value of the bank account in your balance sheet (in box 1) at all, but only in box 3.

Hallo prinsrachid,

 

Dank u voor uw antwoord. Met je laatste advies wil ik "Eigen vermogen" dubbel controleren als mijn bijgevoegde schermafbeelding. Het doel is om alle bedrijfswinst (2018: 2000 euro, 2019: 3000 euro ) naar mijn privé-bankrekening te verplaatsen.

Omdat ik al zo verklaarde:
Boekwaarde begin boekjaar (1 januari 2018) = 0 euro
Boekwaarde einde boekjaar (31 december 2018) = 2000 euro

 

Moet ik dit niet verklaren?

Boekwaarde begin boekjaar (1 januari 2019) = 2000 euro
Boekwaarde einde boekjaar (31 december 2019) = 0 euro

Should not I declare like this?

Boekwaarde einde boekjaar (31 december 2019) = 0 euro

I really can't answer any questions like this, if you do not make it clear what choices you made. I'm trying to go through the process very slowly, but you seem to want to skip right to end, even though we have not established on implicit assumptions the balance sheet is based on. The options and screenshots also make it extra convoluted. I also get the feeling that you equate "Eigen vermogen" with your bank balance, which is not accurate.

 

So, again, first things first. In 2018, did you add any of your bank accounts as a business asset on your balance sheet?

- If you did, you would have filled out the total bank balance of your business bank and/or savings accounts under "Balans (activa) --> Liquide middelen". Is that the case?
- However, if you did not, then that bank account would be a private asset to be filled out under "Bankrekeningen en andere bezittingen" (where you might qualify for an exeption). Is that the case?

Thank you for your reply. I am sorry I was not aware that I was not answering all your questions. I have attached how I declared for Aangifte inkomstenbelasting 2018.

Am I correct?

 

Any from next year, I understand I should define my bank account as private account, and use "privéonttrekkingen" to make  Boekwaarde einde boekjaar = 0 euro.
