How to open a company being an employee

Hello everybody,

 

i'm new in this community, but i need your help....

i'm planning to take over a business, but i also need to continue working in the company where i'm already employed.

Do anyone know if this is possible and how should i proceed?

Guess it al depends on the kind of takeover.

 

If you are buying an ongoing business (with people in place) you are just the new shareholder who can leave the daily affairs to others. But if it is for instance the business of your father who wants to retire, you need to find others to take care of daily business.

Your contract with your employer may limit your ability to work for or own other companies or to compete with your employer. Even if the contract doesn't contain a non-compete clause, a judge may find competing with your boss unlawful.

 

Is this a part-time or a full time job?

 

Does the new company compete with your boss'?

 

Is the new company a legal person?

 

Some countries have more stringent requirements for incorporation than the Netherlands — depending on the type of company, you are not always required to incorporate in the Netherlands. You often will have to register with the Chamber of Commerce and the revenue service.
