i am planning full time family move to Netherlands and trying to understand what my situation will be regarding work and taxes
I’ve been working for a company, registered in EU for the past 5 years
2 years ago, I’ve relocated to another country - therefore terminated my office employee contract and now operating as consultant trough my Ltd., invoicing each month for fixed amount (as per consultancy agreement with the company), living and paying taxes in another EU country.
Now planning to relocate to Netherlands permanently, no changes to situation - will sign new consultancy agreement (to terminate the one with my current Ltd.), can invoice the employing company either as self employed professional, or as business (BV).
Consultancy agreement states :
each party is independent contractor under the agreement
the consultant reports to the CEO
Consultant performs the services in a completely independent manner and under their sole responsibility.
consultant must provide his invoice each month, together with record of hours worked, services provided and relevant expense claims (internet and phone bill)
There are no holidays/sick leave mentioned in the agreement.
I do not use their equipment (only their software). In reality I dont provide the company with anything but the consultancy fee invoice and internet/phone bill (as services and hours are quite clear - as full time employee), but i keep formal records for hours “worked and services provided” - in case of local authorities needs it for a revision. In the official communication with the employing company - i do not send such.
I’ve contacted couple of tax advisors but so far getting conflicting information wether I can be seen as self employed and benefit for certain tax breaks, or this will be seen as fake self-employment and my tax situation would be difficult.
Current income is bit over 70k a year, but will increase to 90k in next few years, which might also mean that operate trough my own BV would be better in the situation
Grateful if anyone can help with some basic explanation on the processes and maybe suggest tax/legal advisor co contact for further help
