Even ter verduidelijking, de bedrijfsvoering van dit Nederlandse bedrijf in volledig in het Engels, mijn man is Engels (woont in NL, werkte voor de Engelse afdeling van de helpdesk) De gesprekken met de patent afdeling gaan ook in het engels.
'het bedrijf' zegt nu al patent aan te hebben aangevraagd in Europa & Taiwan.. maar zegt ook tegelijk mijn mans handtekening nodig te hebben (?) om dus de 'invention' over te dragen aan het bedijf.
Misschien wel interessant is deze laatste email die we hebben gekregen, dan weten jullie van de stand van zaken.. we hebben het gevoel dat het bedrijf ook wat bluft.. maar zijn ook niet zeker van de zaak. Ze zeggen in deze mail dus niet verder te willen onderhandelen, en het patent laten verlopen (?).
Vergeet niet dat ze ons aantal maanden geleden een document hebben gestuurd van 30 pagina's uitgewerkt gedetailleerde beschrijving van het product en idee, wat geschreven is door een patent advocaat (kosten in de 10tallen duizenden). Dus het laten lopen van het patent lijkt me vreemd (gezien de investering die ze al gedaan hebben)..

It does indeed seem that your employment contract terminated as of April 14 2008. Thereafter, as you point out, it seems you were formally employed by an Agency, particularly at the time you say you had the invention.
Ownership of the idea is therefore in doubt. We continue to believe that the idea is the property of 'HET BEDRIJF' , because to all intents and purposes, you were employed at 'HET BEDRIJF's request and cost, albeit through an agency, and you provided services 'HET BEDRIJF'. The fact that you freely submitted your idea on a 'HET BEDRIJF' Invention Disclosure form after the expiry of your contract lends weight to our position, but we respect the fact that you may take a different view.
If you maintain that the idea is your property, and we continue to insist that it is the property of 'HET BEDRIJF', then we have reached the end of negotiations. If you wish to seek re-entitlement of the patent applications we have filed covering the idea (one International Application and one Taiwanese application), then of course that is your prerogative, but from this point forward, and in order that you do not feel that we are stealing your idea, we will not take any further action in connection with either application. The applications will therefore lapse (expire) of their own accord.
We are sorry to have reached this point, but there is little further we can do.
