  1. Ik ben al zo stom geweest mijn adres en telefoonnummer te geven. Die staat standaard als afsluiting onderin mijn mail. Mijn Twitter leeft juist nog, de facebook page was opgeheven, maar die heb ik opnieuw aangemaakt, nu alleen zichtbaar voor Hollanders en Belgen.

  3. Ik heb hulp gehad van iem en heb toen dit naar Lindsay gestuurd: My European trademark attorney wrote me this: "Under European trademark law, an absolute requirement is registration. There is no registered or published pending trademark application for HAPPY HERBIVORE or any variation I can think of. There is no way for her to sue for trademark infringement at this time. If she claims to have a nonpublished pending application, we'll have to wait until it is published so we can file an opposition (protest) based on your prior use in the European Union. It's illegal by the way to falsely claim you have a pending application. We do not have anything similar to the common law trademark right of the US. If it's not registered, you have no rights, no matter how long you used it. She talks about "suing for copyright infringement" but that is something else entirely; we are talking about trademarks, not copyright. There's no way she can sue for copyright infringement over just the word HAPPY HERBI. You are not active in the US so I don't see how you would infringe a US trademark. If she falsely represents to Twitter or Facebook that you are doing so, you'd have grounds to sue her for damages. The TOS for these services require that you *infringe* a trademark, not merely that you have a username that is similar to someone's trademark somewhere in the world." Haar reactie was dit: What your attorney fails to see is that you're using it on Facebook - which is an American company/social platform etc; so even if you're in Holland you are breaching my common law US trademark rights through Facebook and Twitter... and mind you, your attorney pointed out that I have a trademark infringement claim against in the the U.S. under the common law... so you appear to be the ass, not me. Also, I've received emails from a xxx domain, which I've flagged as spam. If you or anyone else you're associated with is trying to send me information -- it must come from a actual domain and valid email address, otherwise it's disregard and marked appropriately as spam and thus, not received. I'll leave the rest of this up to my lawyer and her expertise. This situation is not worth my time, as you pointed out, you are a no body... it's just a shame and a testament to your character how unoriginal you are. Here in America, we call people like you douches. I hope that translates in Dutch. The kind of person you are really shows. Hope that is not representative of the Dutch. Lindsay

Nou aan het juridisch loket, heb ik niet veel: Geachte mevrouw, Indien u de naam blijft gebruiken en de andere partij gaat een gerechtelijke procedure beginnen, zal de rechter bepalen of beide namen zodanig op elkaar lijken, dat er verwarring kan ontstaan.   5. Even ter aanvulling... Ik vroeg haar, zo Heppieherbi of HappyHurby een probleem zijn? Volgens haar we ze stuurt dit: I'll have to ask my lawyer, but I'm certain those would still be an issue because the likeness and idea is so similar. Why not try to create something more original? It is best to distinguish yourself anyway. Maybe try DutchHerbi? I understand that you personally do not feel it is confusing, but it is and would be confusing to other people. My fans call themselves "happy herbis" and I am "happy herbivore" someone could easily mistake "happy_herbi" and this it is me, or something to do with me, or something to do with my fans. This risk of confusion is what makes it a trademark infringement. This mess is why trademark and copyright laws exist in the first place.   6. Ik ben net begonnen met mijn site en bedrijf Happy Herbi. Nu sprak op twitter vrolijk iemand aan met de naam Happyherbivore. Ik vond het juist wel grappig dat we we vergelijkbare namen hebben, maar zij vond het niet zo grappig, want er word meteen gedreigd met een rechtszaak: Ze stuurde me de volgende mail: Hi Daphne! Thanks for emailing me. I hate to be such a pain but my attorney is insisting that it be changed. My lawyer says that since "happyherbi" so similar to happy herbivore it would cause confusion, which makes it trademark infringement. It doesn't matter that you're site or facebook page is less trafficked or less popular than mine -- its the fact that someone might confuse the two. Happy Herbivore has been my brand since 2006. My fans also call themselves "happy herbis" and "happy herbies" -- so that too is an issue. I'm sorry but we have to request that you change your name to something else and stop using happyherbi on twitter, facebook, etc. My book, Happy Herbivore, is also going to be released in your country and I have fans from all over the world, including Dutch fans; so it doesn't matter that you're promoting mostly in another language. There is currently a legal battle going on between a Danish publisher and a U.S. vegan chef for using similar names ("vegan with a vegeneance vs. "vegetarian with a vengeance") and I don't want to end up in that situation. Let me know if you need help coming up with a new name.... and thanks for being so understanding! "happyherbi" would def. cause consumer confusion, which is the standard used for trademark infringement.
